Terms and Conditions
These terms and conditions govern all activities at “Happy Mistakes Art Studio” LLC located at 735 N. Gilbert Road, Suite 130, Gilbert, AZ 85234. By purchasing any activity at Happy Mistakes Art Studio, you agree to be legally bound by these Terms & Conditions and your use shall be subject to these Terms and Conditions, as they may be amended from time to time, without further notice to you. You may obtain the latest Terms & Conditions at the premises or on our website www.happymistakesart.com.
By making a payment for any services provided by Happy Mistakes Art Studio LLC, you explicitly confirm that you have read our terms of service, which are totally understood by you and approved by you to the full extent.
1. REGISTRATION AND CONFIRMATION
1.1 To book any time and day convenient for you to participate in the art experience or any other event on the premises of Happy Mistakes Art Studio, LLC, use our calendar on www.happymistakesart.com and pay for any service chosen by you.
1.2. The majority of our art experiences are held in separate rooms and on an individual basis, which allows you to enjoy the utmost freedom of creativity.
2. PAYMENT
2.1 A full payment is required to book a spot in a class or a program of your choice. Our services can be paid for by credit card on our website www.happymistakesart.com. Cash is not accepted online. If you request additional services on site (increase the size of the canvass, extra paint colors, buy additional protection against paint, order delivery of your painting, and other services), you can always do it using a credit or debit card or cash in the Happy Mistakes Art Studio.
3. ART EXPERIENCE CANCELLATION
3.1 Art experience cancellation by our initiative can occur only due to force-majeure circumstances, and in such a case, we issue a full refund or reschedule your art experience to a different time and date convenient for you.
3.2 In case of a customer-initiated cancellation, we are ready to reschedule your art experience to any available and convenient for you date and time or provide a full refund upon due notification of the cancellation no less than 24 hours before the scheduled time of the art experience. In case of a last-minute cancellation less than 24 hours before the start of your scheduled art experience, no refund is provided even in case of a no-show or sickness.
In case you have booked an art experience for three or more people, cancellation of each individual member of your group should also be made no less than 24 hours before the scheduled time of the art experience. If you decide to decrease the size of your group for the art experience later than 24 hours before the scheduled time of the art experience, there will be no prorated refund.
3.3 If you are more than 15 minutes late for your scheduled art experience, Happy Mistakes Art Studio reserves the right to cancel your art experience and retain 100% of the payment made by you. Each art experience is individual and can be held only within the booked timeframe to keep the order of other scheduled art experiences.
4. ART TOOLS
4.1 The art tools and materials necessary for the art experience are all included in the cost of our art experience, and we make sure there are enough of them at Happy Mistakes Art Studio.
5. PHOTO AND VIDEO RECORDING
5.1 At the Studio, you can take photos and record video, upon our approval use professional equipment for content creation and freely post such photo and video materials with free access over the internet, broadcast in TV programs, etc. Although the majority of our art experiences are individual and held in separate rooms, your participation in any of such events, parties, or art experience at Happy Mistakes Art Studio, automatically entails your approval to be featured in any above-mentioned programs and/or photos without compensation or additional approvals in any form from your end.
6. PAYMENT FOR CORPORATE AND GROUP EVENTS
6.1 Reservation of the date and time for the celebration of private parties, corporate events, or birthdays becomes effective only after a non-refundable advance payment. Full payment for such events is required no less than 7 calendar days before the start time of the event. Contact us with the details of your event and we will send you a custom offer based on your preferences and budget expectations.
7. CANCELLATION AND RESCHEDULING POLICY FOR CORPORATE EVENTS, PRIVATE PARTIES, AND GROUP EVENTS
7.1 In case you need to cancel or reschedule a corporate event, let us know no less than 7 days before the start of your prospective event. In case of cancellation less than 7 business days before the start of the event, we reserve the right to keep 100% of the amount paid. If you want to reschedule, we will do our best to choose a different convenient and available date and time. We charge the date and time rescheduling fee in the amount of $300 (USD), and in case you do not consider rescheduling and refuse to participate in the art experience (within less than 7 business days before the start), all deposits are non-refundable.
7.2 Cancellations or rescheduling attempts less than 7 business days before the start of your event do not include any refund or rescheduling opportunity. In case of rescheduling due to severe weather circumstances, the rescheduling fee is waived.
8. REFUNDS
8.1 Refund processing can take up to 2 weeks, depending on financial instutions.
9. ART EXPERIENCE BOUGHT FROM THIRD PARTIES
9.1 If you booked an art experience or any other program at Happy Mistakes Art Studio through a third party, any refund will be issued from that particular third party.
10. CLIENT’s OBLIGATIONS
10.1 ADAS, LLC; Happy Mistakes Art Studio, and its employees are not responsible for children and adults in case of non-compliance with the safety regulations and rules established by ADAS, LLC and Happy Mistakes Art Studio within the premises of the art space.
10.2 In case of obscene comments made by a client, insults towards the employees or other guests, physical confrontation, and aggression, we reserve the right to refuse the provision of the art experience services to the offender and make the offender leave the premises of the art space. In such a case, the payment made by the offender will be retained in full regardless of the time already spent in the art experience or the remaining time. We reserve the right to fully prosecute any offender in accordance with the law.
11. HAPPY MISTAKES ART STUDIO CUSTOMER SAFETY REGULATIONS
11.1 Our acrylic, water-based paint usually does not cause allergic reactions. Nevertheless, if you believe you may have any medical condition that makes it unsafe for you to participate in this activity, please consult with your doctor or refrain from participating in the art experience.
11.2 Protect your clothes and footwear from paint. Paint is easy to wash off the skin and is difficult to wash off clothes, however, every art experience includes an anti-paint protection set (apron, shoe covers, gloves). If you want to get better protection, please let us know and we can provide it for a separate fee. Under no circumstances (even with better protection purchased) will we be responsible for smudging and smearing on your clothing.
11.3 Among the painting techniques employed at Happy Mistakes Art Studio there is “shooting + spinning”. The art experience includes the use of airsoft guns for shooting projectiles at the balloons filled with paint. Using such guns, make sure to comply with the following safety regulations:
– Do not point the gun at yourself and/or at other people in the art space.
– Do not look down the gun barrel.
– Do not shoot at any other targets except the ones specially designed for the art experience.
– Do not take the gun by yourself, without the operator’s permission.
– Make sure to use disposable plastic glasses when shooting at the balloons (provided by the art space).
To create paintings, we use pottery spinners: the paintings spin on the wheel at a very high speed. Until the wheel has completely stopped spinning, it is strictly prohibited to:
– Try to stop the pottery spinner by yourself.
– Touch the spinning elements of the spinner until it has stopped completely.
– Turn on or turn off the pottery spinner motor on your own.
11.4 If you participate in an art experience with minors, you, as a parent or legal guardian of such minors, are responsible for explaining the safety regulations to them and making sure the rules are complied with.
11.5 Happy Mistakes Art Studio does not assume responsibility for theft or loss of your personal belongings.
11.6 Happy Mistakes Art Studio reserves the right to reject a request for participation in the “shooting + spinning” art experience or any other art experience if a client appears to present visible signs of alcohol or drug intoxication, without refund of the payment made by such a client.
11.7 During the workshop, Happy Mistakes Art Studio Instructors (artists) give recommendations on how to create a picture of the highest quality, but to allow you to fully merge into a creative process, we give you the freedom to choose independently the quantity of paint, mix the paint as you wish and lead other creative processes, thus Happy Mistakes Art Studio is not responsible for the quality of the dry painting, including cracking defects.
11.8 Happy Mistakes Art Studio is not responsible for partial or complete damage to your painting (including loss) from the moment of its hand-over to a courier service, transportation company, or, by your request, to any third party.
11.9 As a condition of taking part in any activity provided by Happy Mistakes Art Studio you agree to execute and sign the Waiver Agreement.
12. PAINTINGS STORAGE PERIOD
12.1 Once the art experience is over, it takes up to 4 days for the painting to get dry. At that time, it is possible that the texture and brightness of the painting would change and/or small cracks will appear on the painting. Our company is not responsible for the natural changes to the painting in the process of drying. You can pick it up on any working day, during open hours, at our studio, with advance notice.
12.2 You can also order delivery of your painting by postal service paying the corresponding postal service fee. Do not hesitate to learn more about delivery options at our studio. We are not responsible for a possible loss of the painting, damages, or other postal service mistakes, including the actions of any third person whom you have authorized to pick up your painting. You may purchase separate insurance for your painting via USPS or other courier services.
12.3 We are obliged to store your painting for no more than 14 calendar days. Once the storage period of 14 calendar days after the completion of your art experience is over, in case we do not receive any additional requests for the storage period extension, your silence will be interpreted as a denial of your rights over the painting. Thus, you transfer to the Studio the rights to do any actions with the painting, including repainting, disposal, giving it as a gift, or selling it.
12.4 In case the painting abandoned by you is discarded, you are not entitled to any compensation from Happy Mistakes Art Studio whatsoever (including actual damages, consequential damages, damages for emotional distress, etc.)
12.5 COVID-19 policy.
If Happy Mistakes Art Studio is required to close due to federal, state, or local public health authorities mandates, your deposit will be transferred to a later date when Happy Mistakes Art Studio is permitted to reopen.
In case you tested positive for COVID-19 after making the reservation of the art experience (confirmed by the test result) and have not informed us of the cancellation more than 24 hours before the start of the art experience, the studio does not provide any refund and will be forced to deny the provision of services to you to guarantee the health protection for our employees and other guests. Arizona stipulates that a person with COVID-19 should stay home, but this regulation does not mean that the entrepreneur should incur losses by initiating a partial or a full refund of the payment made.
